The Office of Solicitor General represents the State in all matters before the Supreme Court of the United States, the federal courts of appeals, and in all multi-state litigation. The Office also manages and oversees specific state and federal cases at the trial and appellate levels.In all cases litigated by the Montana Department of Justice, the Solicitor General may exercise authority to ensure that the State presents consistent, reasoned legal arguments. In addition to cases in which the State is a party, the Office of Solicitor General supervises the State's submission of amicus briefs.At the Attorney General's request, the Office of Solicitor General also provides strategic legal advice on various other matters. The Assistant Solicitor General shall assist the Solicitor General in the commission of these duties.Minimum Qualifications:
  • Juris Doctor Degree.
  • At least two years of specialized law and litigation experience.
  • Admission to and maintenance of licensure from the State Bar of Montana.
  • If licensed in another state, must be able to become licensed to practice law in Montana within six months of hire. Individuals with 5 years of practice in another state in good standing are eligible to be admitted on motion. Individuals who have passed the Uniform Bar Exam may be eligible to transfer.
  • Other combinations of education and experience will be considered on a case-by-case basis.
